Wash water and residues from pressure washing: what the rules say in Malaga province

Wash water carrying paint, pigments, solvents or solids that can block pipes must not go into the public sewer in Málaga city, under its sanitation regulation. Benalmádena has a similar ordinance (only its 2019 initial-approval text was found), and for Marbella and most other coastal towns the local rules have not been verified, so the owner should confirm with the ayuntamiento.

Why does wash water matter at all?

Wash water matters because it carries whatever came off the surface: dust, organic growth, rubber, oil, fuel and sometimes paint flakes or old sealer. Ordinary rain-type dirt is one thing; oily water and paint residue are another.

Where that water ends up depends on the site: a gully into the sewer, a soakaway, the garden, a neighbour's plot, a pool, or the street. Each has different consequences, and some are regulated.

This is why drainage is part of the assessment for every job, alongside the surface and the stains. Our patio and driveway cleaning page lists what we check before we start.

What does Málaga city's sanitation regulation prohibit?

Málaga city's sanitation regulation prohibits discharging into the sewer system all the compounds and materials listed in its Annex 1. The service is managed by EMASA.

According to the Reglamento del Servicio de Saneamiento, article 17, discharges of the substances in Annex 1 are banned. That annex includes:

  • Water-immiscible organic solvents and volatile oils.
  • Colouring materials such as inks, varnishes, lacquers, paints and pigments that cannot be removed by the usual treatment processes.
  • Solids or viscous materials that can obstruct the network.

The page hosting the regulation does not show its date. For anyone cleaning a driveway or stripping a painted floor in Málaga city, the practical message is clear: paint residue, solvents and solids should not be washed into the sewer.

What about Benalmádena, Marbella and other towns?

Benalmádena has an ordinance regulating discharges to the sewer network, beaches and public watercourses. The document we found is the text of its initial approval by the municipal plenary in 2019; its article 7 prohibits water-immiscible organic solvents and paints and pigments that treatment cannot remove. Final approval has not been verified.

MunicipalityStatus of the rules
Málaga (city)Sanitation regulation found; Annex 1 bans paints, pigments, solvents, obstructing solids
BenalmádenaInitial-approval text (2019) found with similar bans; final approval to be verified
MarbellaNo official ordinance found (to be verified)
Estepona, Mijas, Fuengirola, Torremolinos and othersNot checked in an official source (to be verified)
If your property is in a town where the rules are not verified, ask your ayuntamiento or water company before a large clean or any paint stripping. We would rather tell you we have not verified something than guess.

How are paint flakes and solids handled on site?

Paint flakes, failing sealer and other solids should be swept up and collected as the work goes on, rather than flushed along with the water. This keeps them out of gullies and drains and away from planting and pools.

On stripping jobs, collecting residue is part of the work plan from the start. Our old paint removal service explains how stripping is organised, and the guide on removing old paint from outdoor concrete covers why flakes are such a concern.

What about oily water from driveways and garages?

Oily water from driveways and garages needs the same care. Treated oil stains release residue into the wash water, and Málaga's regulation specifically lists water-immiscible solvents and volatile oils among the banned discharges.

Communal garages often have their own drainage channels and, in some buildings, separators; the administrator usually knows how the system is set up. The communal garage cleaning service explains how that is checked, and the oil stain removal page covers the treatment itself. For background on which oil stains respond, see the guide on oil stains on concrete.

What should an owner ask before a clean or a paint strip?

An owner should ask where the water will go, what will be collected, and who checks the local rules. Clear answers to those three questions avoid most problems with neighbours, pools and drains.

  1. Where does water drain on this part of the property, and what lies downhill?
  2. Will oil treatment or paint stripping produce residues, and how are they collected?
  3. Are there gullies, grates or channels that need covering or protecting during the work?
  4. Is the pool, a pond or planting close enough to need protection?
  5. Does the community, if there is one, have rules about using the garage drainage?
  6. Has anyone confirmed the municipal rules where they are not verified?

If you are abroad, these questions can be answered by message with photos of the drains and the surrounding area. A property manager can usually point them out in a few minutes.

Which national rules apply to waste and site safety?

Two national texts frame waste from building work in Spain. Real Decreto 105/2008 regulates the production and management of construction and demolition waste, aiming to encourage prevention, reuse, recycling and recovery. Ley 7/2022 on waste and contaminated soils for a circular economy is the framework waste law, and its article 30 deals with construction and demolition waste.

How small quantities of residue from a residential clean fit into these categories is not something we have verified (to be verified). For site safety on construction works, the reference is Real Decreto 1627/1997, which sets minimum health and safety provisions.

Frequently asked questions

Can I wash my driveway into the street drain?

Plain water with ordinary dirt is a different case from water carrying oil, solvents, paint or solids. In Málaga city, the sanitation regulation bans discharging paints, pigments, certain solvents and obstructing solids into the sewer. Rules elsewhere are not verified, so check with your ayuntamiento.

Are the rules the same in Marbella as in Málaga?

We do not know. We did not find Marbella's ordinance on discharges in an official source, so it is to be verified. Ask the ayuntamiento or the local water company if your job involves paint stripping or oily residues.

Is Benalmádena's ordinance in force?

We found the text of its initial approval from 2019, which prohibits similar substances. We have not verified the final approval or its publication in the provincial bulletin, so treat the details as to be verified. Contact the town hall for the current position before relying on it.

What happens to the paint flakes from my driveway?

They should be swept up and collected during the work rather than washed into drains. How they are disposed of afterwards depends on local arrangements; for large quantities, ask your ayuntamiento how they classify them. Small volumes are often easier to manage than owners expect.

Does moss and dirt from a patio clean need special handling?

Organic debris and ordinary dirt are less of a concern than paints, solvents and oils, but solids can still block drains. Sweeping up debris and keeping it out of gullies is good practice on any site. Leaves and silt collected in gullies are the most common cause of blockages after a clean.

Who is responsible for wash water on my property?

Responsibility questions depend on local rules and on what was agreed for the job, and we have not verified them for each municipality. In practice, the drainage plan should be agreed between the owner and the contractor before work starts.

Does pressure washing need a licence because of the water?

We have not found an official source that addresses licences for cleaning alone (to be verified). Repairs and coatings may require a declaración responsable or a licence depending on the town and the zone, so ask your ayuntamiento. A quick call to the town hall avoids uncertainty.

Can wash water go into my garden?

Clean rinse water is generally less of a concern, but water with oil, treatment residues or paint should not be directed at planting, pools or a neighbour's land. We look at where water flows on your plot during the assessment.

What about the pool next to the area being cleaned?

Wash water and debris should be kept out of the pool. The work direction is planned accordingly, and it can help to let your pool maintenance company know when the surround is being cleaned. Any pool cover should also be checked so dirty water does not collect on it.

Why do you mark some points as to be verified?

Because we only state legal and regulatory points that we have checked in official or reliable sources. Where we could not, we say so openly and send you to the ayuntamiento rather than guessing. Where something is unverified, the text says so in brackets.
